    • I, William Sullivan of the County of Jackson and Territory of Florida being of sound mind and memory, but considering the uncertainty of earthly existence do make and ordain this my last will and testament (revoking all others by me at any time previously made) in manner and form following, that is to say first, that my Executor (hereinafter named) shall provide for my body a decent burial suitable to the wishes of my Relatives and friends, and pay all funeral expenses together with my just debts howsoever and to whomsoever owing out of the moneys that may first come into his hands as a part or parcel of my estate.
      Item 1st I will that all my Property be held together during my wife Olympha Sullivan's widowhood and whatever monis (sic) due me at any time and that shall hereinafter become due and be collected shall be paid out to the best advantage by my executors in the payment of my lawful debts and in the purchase of Negroes.
      Item 2nd I will that in case my said wife Olympha Sullivan marry again that the property be fairly divided and she have on child's part for her proper use.
      Item 3rd I will as my children come of age the balance of my property be re-divided and that each child as he or she comes of age receive his or her property at that time.
      Item 4th I will that all my children be educated in the rudiments of the English language and that the expenses be paid by my executors by the devised means
      I nominate and appoint my wife Olympha Sullivan Executrix and William McNealy and Hugh E. Spears Executors of this my last will and testament, 23rd Febr. 1838.

      Declared by the said William Sullivan to be his last will and testament in presence of us who at his request in his presence and the presence of each other do subscribe our names as witnesses.

      The foregoing will being presented for probate the Court refused to admit it to ___ for the reason that the Statutes of the Territory of 1838 declared that unless a will be attested and subscribed in the presence of three or more witnesses it shall be ___ void and of none effect. There being but two witnesses for this will the court is of the opinion that under the statute it is void. ________________________________________________________________
